British lawmakers have filed a lawsuit to determine whether xAI is legally responsible for images created by Grok.
xAI is under investigation in the EU, UK and California for its freewheeling AI image generator.
Jess Asato, a British Labor lawmaker, sued xAI over sexually explicit AI-generated images Grok created for her, The Financial Times reported. The lawsuit is the first high-profile test in the UK of whether AI companies can be held liable for content created by people using AI tools.
Grok users began creating and sharing images of Asato in January, shortly after it was first reported that the AI assistant had been used to create CSAM. Asato claims users encouraged Grok to create images of herself in a bikini, along with an explicit video showing "her being chloroformed and prepared for sexual assault," the FT wrote. Users later re-shared, discussed, and created more AI images on X, a social platform owned by xAI.

Asato's lawsuit alleges that xAI should be held liable even though xAI is an individual user who uses Grok in violation of laws regarding misuse of personal information and data protection. She is seeking monetary damages and an injunction to force xAI to follow UK law. Asato told the FT: “We hope this will rebalance individual rights against large tech companies that need to put in place safeguards before they harm women and children.”
xAI claimed in January that it had placed restrictions on Grok's ability to generate sexually explicit images, but when tested, the block was fairly easily circumvented. All of this is happening while xAI and X's relatively new owner, SpaceX, is attempting to go public. It's hard to say whether the negative attention will have an impact on Musk's new IPO, but any move to reign in Grok would likely come from regulators or one of these lawsuits rather than the SpaceX CEO himself.
